1. Service Provider

Davide Bollati (P.IVA 02821210024) (hereinafter "VisualTurf"), with registered office in Italy, is the owner and provider of the service accessible at visualturf.ai and app.visualturf.ai.

2. Object and Acceptance

These Terms and Conditions govern access to and use of the VisualTurf platform, a SaaS tool for generating renders and commercial proposals for artificial turf installers. By registering and/or using the service, you fully accept these terms.

3. Service Description

VisualTurf offers:

• Render generation: transforming photographs into realistic visualizations with artificial turf installed using artificial intelligence.

• Commercial proposals: creating and sending professional visual proposals to end clients.

• Catalog management: administration of your own artificial turf models.

• Basic CRM: client and project management.

• Render gallery: storage and management of generated renders.

The service is provided in SaaS (Software as a Service) mode, accessible through a web browser.

4. Registration and Account

To use VisualTurf, you need to create an account providing truthful and up-to-date information. You are responsible for maintaining the confidentiality of your access credentials.

Each account is personal and non-transferable, except in plans that allow multiple users (team). Sharing credentials between different people is not permitted.

We reserve the right to suspend or delete accounts that violate these terms or are used abusively.

5. Plans and Pricing

VisualTurf offers different subscription plans (Free, Starter, Pro) with different features and usage limits. Current prices are displayed on the pricing page.

• Billing: subscriptions are billed monthly or annually depending on the chosen plan, through Stripe.

• Renewal: subscriptions automatically renew at the end of each billing period.

• Plan changes: you can change plans at any time. The new plan will apply at the beginning of the next billing period.

• Cancellation: you can cancel your subscription at any time. You will retain access to the contracted plan until the end of the current billing period.

• Additional packs: additional render packs never expire and are consumed in purchase order (FIFO).

We reserve the right to modify prices with a minimum notice of 30 days.

6. Intellectual Property

• User content: the images you upload and renders generated are your property. VisualTurf claims no ownership rights over them.

• License of use: by uploading content, you grant us a limited license to process images for the purpose of providing the service (render generation).

• Platform: the software, design, brand, code, and content of VisualTurf are the exclusive property of Davide Bollati (P.IVA 02821210024) and are protected by applicable intellectual property laws.

7. Acceptable Use

By using VisualTurf, you agree not to:

• Upload illegal, offensive, defamatory content or content that violates third-party rights.

• Use the service for purposes other than generating artificial turf renders and commercial proposals.

• Attempt to access restricted areas, compromise security, or interfere with the platform's operation.

• Resell, sublicense, or redistribute access to the service without authorization.

• Use automated systems (bots, scrapers) to access or extract data from the platform.

8. Availability and Support

VisualTurf commits to maintaining 99.5% monthly service availability, excluding scheduled maintenance which will be communicated in advance.

Technical support is provided via email (info@visualturf.ai) with response times according to the contracted plan: up to 48h for Free, 24h for Starter, and priority for Pro.

9. Limitation of Liability

VisualTurf is provided "as-is". We do not guarantee that the service will be uninterrupted or error-free.

To the extent permitted by law, VisualTurf's total liability for any claim arising from use of the service shall be limited to the total amount paid by the user in the 12 months preceding the event giving rise to the claim.

VisualTurf shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or reputation.

10. Termination

Either party may terminate the contractual relationship at any time:

• User: by canceling the subscription from the settings panel or requesting it by email.

• VisualTurf: for breach of these terms, with 15 days' prior notice except in case of serious breach.

After termination, user data will be retained for 30 days to facilitate migration, and subsequently deleted in accordance with our Privacy Policy.

11. Governing Law and Jurisdiction

These Terms are governed by Italian law and Regulation (EU) 2016/679 (GDPR). For dispute resolution, the courts of Davide Bollati (P.IVA 02821210024)'s registered office in Italy shall have jurisdiction, without prejudice to any rights that applicable consumer protection law may confer on the user.

12. Modifications

We reserve the right to modify these Terms. Substantial changes will be notified at least 30 days in advance via email or through the platform. Continued use of the service after notification constitutes acceptance of the new terms.
